WILL WRITING

Instructions for your Will are taken in the privacy and comfort of your home, place of work or if you so wish, at either of our offices. Returned a few days later, the Will is read and you, the client, if happy with the contents, will sign the Will, alongside your own appointed witnesses, or if none are available, witnesses can be provided. 


Making a Will in this uncertain financial climate will help secure the future of your chosen beneficiaries and ensure that those you love and care about are provided for.


If you already have written a Will, we also provide a service to review your Will, ensuring that your wishes and current financial situation regarding your beneficiaries are all up to date and still meet with your requirements. As with everything in life, circumstances change and even the contents and beneficiaries of your Will may too.

PROBATE SERVICES

‘Probate’ is a term commonly used when talking about applying for the right to deal with a deceased person’s affairs (called “administering the estate”). If the person who died leaves a Will, executors may have been named in the Will to deal with the person’s affairs after their death. We, at Kerland Pitman Ltd., offer the relevant assistance, to apply for “grant of Probate”, from the Probate Registry.


All paperwork is performed for the Executor regarding the deceased person’s assets (property, money and possessions). The grant gives the Executor the right to access funds, sort out finances and collect and share out the deceased person’s assets as set out in the Will. If the deceased person died without leaving a Will, a close relative of the deceased person may apply to the Probate Registry to deal with the Estate. We would, as before, offer assistance to apply for a “grant of Letters of Administration”. If the grant is given to the relative, they will then be known as “administrators” of the Estate. This grant, as with the grant of probate, gives authority to that person/relative to deal with the deceased person’s assets.

LASTING POWER OF ATTORNEY (LPA)

A Lasting Power of Attorney is a legal document used to appoint another person or persons (known as “the Attorney(s)”) to act on your behalf.


We, at Kerland Pitman Ltd, prepare Lasting Power of Attorney to meet your specific needs and can act as your Certificate Provider and Witness on the documents. We also complete the process of registering the Lasting Power of Attorney at court for you, which is a legal requirement to make the document usable.

FUNERAL PLANS

Kerland Pitman Ltd. provide a simple application process for Funeral Plans, making the whole choosing of, and paying for, your funeral, as stress free and mind settling as is possible. Funeral planning is something no one really wants to think about, but fortunately now plans are in place that take away the worry one feels about passing away, having not dealt with the final deed of a funeral, the costs, the funeral directors etc. etc.


With our assistance and guidance through this process you will have made the arrangements in advance, selected the funeral director and taken care of the costs. This in itself is the biggest reassurance you can give yourself and your family as it means both you and they will not face the uncertainty or worry of what happens after you pass away. Our Funeral Plans give you, our client, peace of mind knowing all the arrangements are taken care of in advance.

TRUSTS

A Trust is a legal arrangement where one or more 'trustees' are made legally responsible for the holding of assets. The assets may be land, buildings, money, shares or even antiques. These assets are placed in Trust for the benefit of one or more 'beneficiaries'. The Trustees are responsible for managing the Trust and carrying out the wishes of the person who has put the assets into Trust known as the 'settlor'. The settlor's wishes for the Trust are usually written into their Will or set out in a legal document called 'the Trust Deed.'


Kerland Pitman Ltd. are able to help you, the client, to structure your affairs, guiding you through the process of the legal relationships and obligations involved. We will assist in the drawing up of the principal document creating the Trust known as “the Trust Deed”.

INHERITANCE TAX PLANNING

Inheritance Tax is the tax payable on what people leave behind when they die. Everyone is allowed to give, to whoever they wish, assets of a certain value which is exempt from Inheritance Tax, currently this is 40% on any assets over £325,000 (2019/2020).  You can pass a home to your husband, wife or civil partner when you die.  There is no Inheritance Tax to pay if you do this.  If you decide to leave the home to another person in your will, it counts towards the value of the estate.  If you own your home (or a share in it) your tax-free threshold can increase to £475,000 if: 

   -  you leave it to your children (including adopted, foster or stepchildren) or grandchildren; 

   -  your estate is worth less than £2 million.
